§1 General

These General Terms and Conditions govern the cooperation between the contracting parties in the recruitment of potential employees with the aim of employment as a nursing professional in the Federal Republic of Germany in connection with the respectively agreed personnel placement contracts. These General Terms and Conditions are an integral part of the personnel placement contract with the client.

§2 Services

  1. CARE supports the client on a contract-by-contract basis in the placement of nursing staff for a client location in the Federal Republic of Germany. The persons recruited (candidates) are initially employed in Germany as nursing assistants. After full professional recognition by the German authorities, they are employed as nursing professionals.
  2. CARE’s placement services include, in particular, providing language training for the candidates, at least up to the language level required for entry, as well as supervising and supporting the candidates through the immigration process until they enter the country.

§3 Personnel Placement

  1. CARE undertakes to recruit personnel for the Client in the health sector (“Specialist”) in accordance with a written order (“Job Order”) issued by the Client. The Job Order must include details of the position to be filled, the number of Specialists required, the monthly base salary and the terms of the contract. The Client must confirm acceptance of the Job Order (“Order Confirmation”).
  2. The parties agree that the personnel placement process will proceed as follows: The Client issues a placement order to CARE by sending a Job Order. CARE then selects suitable professionals and sends the Client candidate profiles and, if applicable, complete documents. If both parties are interested, CARE organizes a digital interview.
  3. For candidates from the applicant pool, special conditions of the quality seal apply, such as transparent information about the recruiting process, querying of matching preferences and application of the “employer pays” principle.

§4 Performance of the contract and notification obligations

  1. The placement contract is considered fulfilled when an employment contract has been concluded between the client and the placed specialist. The start of the employment relationship is not decisive.
  2. If the language training or employment is terminated within six months, CARE is obliged to find a replacement free of charge within three months.

§5 Placement fee

  1. If a contract is signed, a placement fee plus VAT is due. This is payable in three instalments: upon signing of the contract, upon the specialist’s arrival in Germany and after six months of employment.
  2. The fee covers all services, unless additional agreements have been made.
  3. Additional costs will be charged as they arise.
  4. Payment is due within 14 days of receipt of invoice. Payment will be made in euros by bank transfer.

§6 Liability/Warranty

  1. Information about the specialist is based on information from third parties. CARE is only liable for gross negligence or positive knowledge of incorrect data.
  2. No liability is accepted for the specialist’s activities or obligations resulting from the employment relationship.
  3. CARE is not liable for the client’s compliance with the obligations towards the specialist.
  4. CARE guarantees that no impermissible repayment or binding clauses are included in employment contracts.
  5. The client is obliged to promote the integration and induction of the specialists provided.
  6. Recognition of the legal regulations and freedom of choice of the specialists in compensatory measures.
  7. Cooperation only with clients who fulfil the conditions of the quality seal.
  8. CARE reserves the right to conduct audits as needed.
  9. CARE reserves the right to extraordinary termination in the event of repeated violations of the GTC.

§7 Corporate principles / Code of Conduct

The corporate principles and the Code of Conduct are part of the GTC and can be viewed at care-recruit.de.

§8 Contract duration, termination

  1. The contract is concluded for an indefinite period of time, unless otherwise agreed, and can be terminated with a notice period of three months.
  2. The right to extraordinary termination remains unaffected.
  3. Amendments must be made in writing. There are no verbal ancillary agreements.
  4. Placement orders at the time of termination will be processed as usual, unless this is unreasonable for one of the parties.

§9 Final Clauses

The law of the Federal Republic of Germany shall apply, excluding international uniform law. The place of jurisdiction is Stuttgart.
