§1 General

These General Terms and Conditions govern the cooperation between the contracting parties in the recruitment of potential employees with the aim of employment as nursing staff in the Federal Republic of Germany in conjunction with the respective agreed recruitment contracts. These General Terms and Conditions are an integral part of the recruitment contract with the client.

§2 Services

  1. CARE supports the client in the placement of nursing staff for one of the client’s locations in the Federal Republic of Germany. The recruited persons (candidates) are usually initially employed in Germany as nursing assistants. After full professional recognition by the German authorities, they are employed as nursing professionals.
  2. CARE’s placement services include, in particular, monitoring and accompanying the language training of the candidates at least up to the language level required for entry as well as the legal immigration procedure until the candidates enter the country.

§3 Personnel placement

  1. As part of its recruitment services, CARE shall search for employees in the healthcare sector (“specialist”) on behalf of the client in accordance with a written order (“job order”) issued by the client. The Job Order must contain details of the position to be filled, the number of specialists required, the basic monthly salary and the terms of the contract. Acceptance of the job order must be confirmed by the client (“order confirmation”).
  2. According to the common understanding of the contracting parties, the recruitment process is as follows: The client places a placement order with CARE by sending a job order. CARE then selects suitable specialists and sends the client applicant profiles and, if necessary, complete documents. If both parties are interested, CARE organizes a digital job interview.
  3. Special conditions of the seal of approval apply to candidates from the applicant pool, such as transparent information about recruiting, querying matching requests and applying the “employer pays” principle.

§4 Fulfillment of the contract and notification obligations

  1. The placement contract is deemed to have been fulfilled when an employment contract has been concluded between the client and the placed specialist. The start of the employment relationship is not decisive.
  2. If language training or employment is discontinued within six months, CARE undertakes to provide a free follow-up placement within three months.

§5 Agency fee

  1. If a contract is concluded, a placement fee plus VAT will be charged. This is due in three installments: when the contract is concluded, when the specialist arrives in Germany and after six months of employment.
  2. The remuneration includes all services, unless additional agreements exist.
  3. Further costs will be charged as incurred.
  4. Payment term: 14 days after receipt of invoice. Payment is made non-cash in Euro.

§6 Liability / Warranty

  1. Details of specialists are based on information provided by third parties. CARE is only liable in cases of gross negligence or positive knowledge of incorrect data.
  2. No liability for activities of the specialist or obligations resulting from the employment relationship.
  3. CARE is not liable for the client’s compliance with its obligations towards the specialist.
  4. CARE guarantees that there are no inadmissible repayment or binding clauses in employment contracts.
  5. The client undertakes to promote the integration and induction of the skilled workers placed.
  6. Recognition of legal regulations and freedom of choice for professionals in compensation measures.
  7. Cooperation only with clients who fulfill the conditions of the quality seal.
  8. CARE reserves the right to conduct audits on an ad hoc basis.
  9. CARE reserves the right to extraordinary termination in the event of repeated breaches of the GTC.

§7 Corporate principles / principles of conduct

The company principles and the principles of conduct are part of the GTC and can be viewed at care-recruit.de.

§8 Term of the contract, termination

  1. Unless otherwise agreed, the contract is open-ended and can be terminated with a notice period of 3 months.
  2. The right to extraordinary termination remains unaffected.
  3. Changes must be made in writing. Verbal collateral agreements do not exist.
  4. Placement orders at the time of termination will be processed as normal, unless this is unreasonable for one of the parties.

§9 Final provisions

The law of the Federal Republic of Germany shall apply to the exclusion of international uniform law. The place of jurisdiction is Stuttgart.
